UNREVIEWED DRAFT · NICHT GEPRÜFT

0. Scope of this text

This withdrawal notice applies to distance contracts in which the Operator is the seller. When paid reports and subscriptions are purchased via Paddle as merchant of record, the purchase contract is concluded with Paddle (see T&C Section 1(3)); in that respect Paddle as seller provides its own withdrawal notice and administers the withdrawal. For transparency and precaution, the statutory withdrawal notice under the official model (Anlage 1 EGBGB) is reproduced in full below.

Withdrawal notice

Right of withdrawal

You have the right to withdraw from this contract within fourteen days without giving any reason.

The withdrawal period is fourteen days from the day of the conclusion of the contract.

To exercise your right of withdrawal, you must inform us ([FIRST AND LAST NAME], [STREET AND HOUSE NUMBER], [POSTAL CODE CITY], phone: [PHONE NUMBER], e-mail: [E-MAIL ADDRESS]) of your decision to withdraw from this contract by an unequivocal statement (e.g. a letter sent by post or an e-mail). You may use the attached model withdrawal form for this purpose, but it is not obligatory.

To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.

Consequences of withdrawal

If you withdraw from this contract, we shall reimburse to you all payments received from you, including the costs of delivery (with the exception of the supplementary costs resulting from your choice of a type of delivery other than the least expensive type of standard delivery offered by us), without undue delay and in any event not later than fourteen days from the day on which we are informed about your decision to withdraw from this contract. We will carry out such reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of such reimbursement.

The content consists of digital content not delivered on a physical medium. Therefore no delivery costs and no return costs arise.

Lapse of the right of withdrawal for digital content (§ 356(6) BGB)

The right of withdrawal lapses in a contract for the supply of digital content not on a physical medium (e.g. digital reports) where

  1. the trader has begun performance of the contract,
  2. the consumer has expressly consented to the trader beginning performance before the expiry of the withdrawal period,
  3. the consumer has confirmed their knowledge that, by giving this consent, their right of withdrawal lapses upon the beginning of performance, and
  4. the trader has provided the consumer with a confirmation pursuant to Section 312f BGB.

Effect: with your express consent to immediate commencement of performance and your confirmation that you are aware of the resulting loss of the right of withdrawal, your right of withdrawal lapses upon commencement of performance (i.e. upon provision/unlocking of the respective digital content). If you have not given this consent, the statutory withdrawal period of fourteen days from the conclusion of the contract applies.

[Checkout / integration note — not part of the model text:] the consent under No. 2 and the acknowledgment under No. 3 must be obtained before purchase via a separate, pre-unticked checkbox (do not bundle with the T&C checkbox). After purchase, the consumer must promptly be given a confirmation under Section 312f BGB on a durable medium (e.g. e-mail) recording the consent and the acknowledgment.

Model withdrawal form

(If you want to withdraw from the contract, please fill in this form and send it back.)

Note on processing via Paddle

Where the purchase contract is concluded via Paddle as merchant of record, Paddle is the seller and is responsible for withdrawal; the exercise of the right of withdrawal is then governed by Paddle's information in the order process and the Paddle Buyer Terms ([PADDLE BUYER TERMS URL]). Independently of this, the consumer's statutory rights of withdrawal apply.
